GENERAL SALES CONDITIONS

Preamble

The internet site www.etyket.com, just as the brand etyket.com are SARL BANDS & NAMES property. Any reproduction, full or partial, of any content of this site must have the approval from Bands & Names legal representative. The links to reach this internet site, such as the type of hyperlinks are not permitted without the explicit authorization from Bands & Names.

1.    Conditions acceptance

The customer acknowledges when ordering, the general sales conditions announced in the PC screen and declares to accept them without reserve. These general sales conditions define the sales conditions between Bands & Names and the customer, both sides accept them without reserve.

2.    Exclusions of responsibility

The types of writing, colors and drawings showing the products in this internet site might have slight differences with the final product. If some errors are found, in any case, the SARL Bands & Names responsibility can be engaged. The proposed products at www.etyket.com respect the French laws , it is the customer duty, under his responsibility, to verify that these products can be imported to the final destination country.

3.    Order

The order system back up can be considered as proof of the nature of the transaction, its contents and its date. Bands & Names confirms the acceptance of the order by sending an email to the address communicated during the order process. The sale transaction is not validated until the order is confirmed. Bands & Names keeps the right to cancel the order coming from a customer with payment issues from previous orders.The accuracy of the personal information provided by the customer, during the order process, is responsibility of the client. In case of errors making impossible the reception of the products, the seller can not be considered as responsible of the lack of reception.

4.    Shipping

After confirming the order, Bands & Names delivers within 3 days the products to the designated mail service company (La Poste, Correos, Deutsche Post, Royal Mail or others) in charge of shipping the products ordered to the final destination. The announced period for taking care of the order at the internet site is the maximum in which Bands & Names agrees to submit the order to the mail service company. The period needs to be adjusted taking into account the period of the mail services company (between 3 and 5 days)The delivering within the EU and Switzerland is charge free. The delivering out of the EU and Switzerland is also charge free. For urgent cases contact us.The final destination of products is defined in the order. The customer address and the delivering address can be different. This option does not imply any extra charge.Orders paid by cheque will not be taken in charge until the reception of the payment. The period needs to be calculated considering the reception of cheques. The delays do not give right to any claim. In case of proven errors, the customers benefits of the return under conditions defined in this document.It can be considered as force majeure discharging the seller from his obligation to deliver, the war, riots, natural catastrophes, fires, strikes, accidents and/or the impossibility of being supplied.

5. Return of products

Customers have 7 days after reception to return defective products. Bands & Names will replace the products if its responsibility is engaged. The return charges assumed by the customer will be compensated by delivering additional products. The right of retraction can not be exercised for products designed following the guidelines of consumers or in those cases where products are clearly personalized as defined in the French Consumer Code L.121-20-2.

6. Price

The price is defined in Euros. The price indicated in the products features does not include the delivering fees for those cases defined in this document. The price indicated during the order confirmation is the final price, and includes all charges and taxes including the VAT. The price includes the product prices, transportation, packaging and product conservation.

7. Payment

The price invoiced to customer is indicated in the order confirmation sent by Bands & Names. The invoice is paid the day the order is effective. The payment can be done by check, transfer or credit card. The order will not be final until the bank payment centre does not validate it.

8. Litigation

This contract follows the French laws. Bands & Names can not be considered responsible for any inconvenience or damaged caused by a low/wrong performance of the internet, the PC virus or external intrusions or any other case of force majeure that might be defined by Law Courts. Bands & Names responsibility, in any case, will be limited to the order amount and it can not be engaged by simple errors or omissions that might subsist even after all precautions taken to present the products.In case of difficulties to apply this contract, the seller has the possibility, before attacking in justice, of searching a friendly solution with the help of any consumer association or any other kind of consultant of his choice. We remind you that the search of a friendly solution does not stop the legal guarantee of defective products or the warranty duration. We also remind you the general rule, if the Law Courts do not establish something different, to respect the payment engagement agreed by the customer. Complaints will be watched closely, assuming in all cases the good faith of the person who takes the initiative of exposing the case. In case of litigation, the customer will firstly address his concerns to Bands & Names in order to find a friendly solution. If a friendly solution is not agreed, the Commerce Court of Poitiers in France is the only competent, independently of the delivering address of products or the payment method used.

9. Legal information

The personal information collected to set up the distance sale is compulsory. This information is essential to treat the commercial order, to deliver the products and to issue the invoices.The lack of this personal information implies the invalidation of the commercial order. According to the French law of January 6, 1978 on information Technology, you have the right to access to this data, to modify it, to correct it and to delete it.If you want to exercise the right you can directly do it in this internet site or send us an email providing, name, family name, address and email address. In addition, Bands & Names is engaged to not communicate this information to anybody, free or by financial compensation, the customer personal data without his agreement.
